A person is rated for Div 3 if he/she was <1600 rated when he registered for the contest.
So technically an expert can give a rated Div 3.
I do not think that's how things work, after the div2 contests ratings have updated, the ratings of div3 will be calculated, meaning that expert after div2 will be unrated in div3, even if he Registered as specialist.
